IR35 does not apply to sole traders. The off-payroll working rules only apply to workers providing their services through an intermediary, such as a limited company (often referred to as a personal service company, or PSC), or a partnership.
Because sole traders operate as individual entities without an incorporated structure, they fall completely outside the scope of the off-payroll working legislation (Chapter 10 ITEPA 2003). However, hiring businesses cannot assume that engaging a sole trader removes all tax liabilities. While IR35 is irrelevant here, standard employment status rules still apply to every direct engagement.

This risk is managed under traditional employment status law rather than off-payroll legislation, although both use the same tests for determining status. The responsibility for determining whether an engagement constitutes true self-employment or employment always rests with the hiring organisation. When reviewing an engagement, HMRC investigates the actual working practices, focusing on control, personal service, mutuality of obligation, and other relevant factors.
